Terms of Use — Care at Home (Michigan)

Effective Date: August 17, 2025

1) Acceptance of these Terms

By using our website, calling/texting us, emailing us, or otherwise interacting with Care at Home, you agree to these Terms of Use and to our Privacy Policy. If you don’t agree, please don’t use our services.

2) What we do (and what we don’t)

  • We help families navigate Michigan Medicaid personal-care programs (e.g., MDHHS “Home Help”) — eligibility guidance, paperwork, coordination, and ongoing support.

     

  • We are not the State of Michigan and we don’t approve eligibility, hours, or benefits.

     

  • We don’t provide medical, legal, or tax advice. Any decisions are yours. If you need professional advice, please consult a licensed professional.

     

3) No guarantees (eligibility, hours, pay)

Program eligibility, authorized hours, and ongoing services are determined by the State of Michigan or its contractors. We can’t and don’t guarantee approvals, specific hours, timelines, or benefit levels. If your situation changes or the program rules change, outcomes may change.

4) Your responsibilities

You agree to:

  • Provide accurate information and update it if it changes.

     

  • Have permission to share another person’s information if you submit on their behalf.

     

  • Use the site and services legally (see “Prohibited Uses” below).

     

  • Keep your account/communications secure (e.g., your email/phone).

     

5) Communications consent (calls & texts)

By providing your phone number and clicking submit or contacting us, you consent to receive calls and/or text messages (including via auto-dialer) from Care at Home about eligibility, enrollment, and services. Message/data rates may apply.

  • Opt-out: Reply STOP to any text to stop. Reply HELP for help. You can also email info@careathome.com or call 1-800-888-1818 to update preferences.
    We may record or monitor calls for quality and training. Tell the advisor at the start of the call if you prefer not to be recorded.

     

6) E-Signature & electronic records

You consent to receive disclosures, forms, and notices electronically and to sign documents electronically where applicable. If you prefer paper copies, let us know; processing may be slower.

7) Payroll & compensation clarity

If you become an approved caregiver, pay is tied to authorized hours and applicable program rules. Our current caregiver base rate is $19/hour for approved Home Help hours and is paid weekly via our payroll process. Rates and processes may change; we’ll notify you of material changes. Applicable taxes and withholdings apply.

We are not promising employment by the state or any third party. Participation requires eligibility, enrollment, and continued compliance with program rules.

8) Privacy; HIPAA

Your privacy matters. See our Privacy Policy for how we handle personal information.
If you become a client/patient, certain information may be Protected Health Information (PHI) under HIPAA. Our Notice of Privacy Practices (HIPAA NPP) governs how we use and disclose PHI; these Terms do not replace the HIPAA NPP.

9) Third-party services & links

Our site may link to third-party sites or use third-party tools (e.g., scheduling, e-signature, analytics, EVV/timekeeping, payroll). We’re not responsible for third-party content, policies, or practices. Review their terms and privacy policies.

10) Intellectual property & permitted use

The website’s content, design, logos, and materials are owned by or licensed to us. You may use the site for personal, lawful purposes. You may not copy, distribute, modify, reverse engineer, or exploit site content except as allowed by law or with our written permission.

11) Prohibited uses

You agree not to:

  • Misrepresent identity, authorization, or eligibility.

     

  • Upload or transmit anything unlawful, harmful, or invasive (e.g., malware, spam).

     

  • Attempt to access non-public systems, data, or accounts.

     

  • Interfere with site operation or security.

     

  • Use the site to harass, discriminate, or violate others’ rights.

     

12) Feedback

If you give us ideas or suggestions, you grant us a non-exclusive, royalty-free, worldwide license to use them without obligation.

13) Disclaimers

The site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose, non-infringement, and availability. We don’t warrant uninterrupted or error-free operation.

14) Limitation of liability

To the fullest extent permitted by law, we’re not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising from or related to your use of the site/services. Our total liability for any claim is limited to the greater of (a) $100 or (b) amounts you paid us in the 3 months before the claim.

15) Indemnification

You agree to indemnify and hold us harmless from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the site/services, your breach of these Terms, or your violation of law or third-party rights.

16) Governing law; venue

These Terms are governed by the laws of the State of Michigan, without regard to conflicts of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Michigan for any dispute not subject to another agreement between us.

If you prefer binding arbitration and/or a class-action waiver provision here, say the word and I’ll add a Michigan-appropriate clause (or a small-claims carve-out) that legal can review.

17) Changes to these Terms

We may update these Terms from time to time. When we do, we’ll update the Effective Date above. Your continued use of the site/services after changes means you accept the updated Terms.
